Penalties

IF CONVICTED OF DUI YOU CAN EXPECT THE FOLLOWING PUNISHMENT:

1st DUI:

  • At least a $500 fine (may be up to $1,000)
  • A jail sentence of not more than six months (no minimum mandatory)
  • A driver's license suspension of 6 months
  • Substance abuse screening and any recommended treatment
  • 50 hours of community service (possible to buy out at $10 per hour)
  • 10 day vehicle impoundment
  • One year of probation

1st DUI - Breath Alcohol level above .15 or minor under 18 years of age in car will result in these enhanced additional penalties

  • A fine of not less than $1,000 or more than $2,000
  • A jail sentence of not more than nine months (no minimum mandatory)
  • Six months ignition interlock device

2nd DUI within five years:

  • A fine of not less than $1000 or more than $2000
  • Mandatory 10 days in jail or more
  • 5 YEAR DRIVERS LICENSE SUSPENSION
  • Substance abuse screening and any recommended treatment
  • 30 day vehicle impoundment
  • Monthly reporting probation
  • One year ignition interlock device

2nd DUI within five years - Breath Alcohol level above .15 or minor under 18 years of age in car will result in these enhanced additional penalties

  • A fine of not less than $2,000 or more than $4,000
  • A jail sentence of not more than twelve months
  • Two year ignition interlock device

3rd DUI within ten years:

  • A fine of up to $5000
  • A minimum jail sentence of 30 days (up to five years if charged as a felony - see below)
  • 10 YEAR DRIVER'S LICENSE SUSPENSION
  • Substance abuse screening and any recommended treatment
  • 90 day vehicle impoundment
  • Monthly reporting probation
  • Two year ignition interlock device
  • This offense may be charged by the State as a 3rd degree felony, punishable as provided in s. 775.082, s. 775.083, or s. 775.084

3rd DUI outside of ten years:

  • A fine of not less than $2,000 or more than $5,000
  • A jail sentence of not more than 12 months
  • A driver's license suspension of one year
  • Substance abuse screening and any recommended treatment
  • 50 hours of community service (possible to buy out at 10$ per hour)
  • 90 day vehicle impoundment
  • One year of probation
  • Two year ignition interlock device

3rd DUI - Breath Alcohol level above .15 or minor under 18 years of age in car will result in these enhanced additional penalties

  • $4,000 FINE

4th DUI

A conviction for a fourth offense is a third degree felony punishable by up to five years in prison and fines of up to $5,000.00.

DUI involving serious bodily injury

3rd degree felony punishable by up to five years in prison and fines of up to $5,000.00.

DUI Manslaugter

DUI resulting in the death of a human being is a 2nd degree felony punishable by up to 15 years in prison and fines of up to $10,000.00.
